Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Keyvalue Software Systems Private Limited (“Company”, “we”, “us”, or “our”) governing your access to and use of Daily Tadka, including the mobile application, website, and all related services available at getdailytadka.in (collectively, the “Service”).

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Definitions

• “Content” means any photos, images, templates, or other materials available through or created using the Service.
• “User Content” means photos and other materials that you upload to your asset library or use for overlays.
• “Template” means a pre-designed, ready-to-use image layout provided by Daily Tadka that users can browse and personalize with overlays.
• “Overlaid Content” means a design created by combining a Template with your User Content through the client-side overlay editor.
• “Subscription” means a paid auto-renewable plan that unlocks download and share features, as described in Section 9.
• “Introductory Trial” means a limited-time paid trial (currently ₹5 for 5 days) that converts to a monthly Subscription unless cancelled before the trial ends.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you may only use the Service with the consent of a parent or legal guardian, in accordance with applicable law including the Digital Personal Data Protection Act, 2023 (DPDPA).

By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms.

4. Account Registration and Security

To use Daily Tadka, you must create an account using your mobile phone number and OTP-based verification. You agree to:

• provide accurate and current information during registration;
• maintain the security of your account credentials and device access;
• notify us immediately of any unauthorised use of your account;
• not create more than one account per individual;
• not share, transfer, or sell your account to any other person.

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Service Description

Daily Tadka is a mobile application for browsing and personalizing ready-to-use image templates. The Service works as follows:

• Template Browsing: Browse a curated library of ready-to-use templates after signing in.
• Asset Library: Upload and store your own images for reuse when personalizing templates.
• Client-Side Overlay: Place your images on templates and adjust overlay position on your device. Overlay compositing is performed locally on your device and is not processed by server-side AI.
• Download & Share: With an active Subscription, save overlaid designs to your device gallery or share them through supported apps.

6. User Content and Uploads

By uploading photos or other content to the Service, you represent and warrant that:

• you own the content or have obtained all necessary rights, permissions, and consents to upload and use it;
• if the content contains another person’s likeness, you have that person’s consent;
• the content does not infringe any third party’s intellectual property, privacy, publicity, or other legal rights;
• the content does not violate any applicable law, regulation, or these Terms.

You grant Daily Tadka a non-exclusive, worldwide, royalty-free, limited licence to store and transmit your User Content solely for the purpose of providing, operating, securing, and supporting the Service (including syncing your asset library across devices where supported). This licence terminates when you delete your content or account, except to the extent we are required to retain data for legal or regulatory purposes.

7. Overlaid Content

Subject to your compliance with these Terms and your Subscription status where applicable:

• you may use Overlaid Content for personal, non-commercial purposes without restriction;
• commercial use of Overlaid Content may be restricted or require a separate written agreement with us;
• you are solely responsible for how you use, distribute, or share Overlaid Content;
• you may not misrepresent the origin of content created using Daily Tadka templates.

Daily Tadka does not claim ownership of Overlaid Content you create. We retain all rights in the underlying Templates and platform.

8. Acceptable Use Policy

You agree not to use the Service to:

• upload, create, or distribute content that is illegal, obscene, defamatory, threatening, harassing, or hateful;
• create misleading media or content intended to deceive, defraud, impersonate, or harm any person;
• upload photos of individuals without their knowledge or consent for harmful purposes;
• infringe upon the intellectual property, privacy, or publicity rights of any third party;
• attempt to reverse-engineer, decompile, or extract the source code of the Service;
• circumvent subscription checks, download restrictions, or other access controls;
• use the Service for any activity that violates applicable law.

9. Subscriptions and Payments

Download and share features require an active Subscription. Daily Tadka offers the following plans:

Monthly and yearly plans include the same features — only the billing period differs. Subscriptions are managed through Apple In-App Purchase (iOS), Google Play Billing (Android), and RevenueCat for entitlement management.

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions through your device’s app store account settings or within the app where available.

10. Free Access vs Subscription Features

After creating an account, you may use the following features without a Subscription:

• browsing ready-to-use templates;
• uploading images to your asset library;
• using the client-side overlay editor to preview personalized designs.

The following features require an active Subscription:

• downloading templates and overlaid designs;
• sharing designs through supported apps (including WhatsApp where available).

11. Refunds and Cancellations

Purchases made through the Apple App Store and Google Play Store are managed by the respective platform. Daily Tadka does not directly process refunds for in-app purchases made through these stores.

• iOS (Apple App Store): Refunds are subject to Apple’s billing policies. Request a refund through your Apple ID account settings, at reportaproblem.apple.com, or by contacting Apple Support.
• Android (Google Play Store): Refunds are subject to Google Play’s billing policies. Request a refund through Google Play or by contacting Google Support.

Cancellation takes effect at the end of the current billing period. You may retain subscription benefits until that period ends. No partial refunds are issued for the remaining portion of a cancelled billing period, unless required by applicable law or the respective platform’s policies.

12. Intellectual Property

All rights, title, and interest in and to the Service — including the Daily Tadka brand, logo, software, templates, user interface, and documentation — are owned by or licensed to Keyvalue Software Systems Private Limited.

You may not copy, reproduce, distribute, modify, create derivative works of, or otherwise exploit any part of the Service or its intellectual property without our prior written consent.

13. Third-Party Services

The Service relies on third-party providers for cloud infrastructure, payments, analytics, and other functions, including:

We are not responsible for the availability or performance of third-party services. Your use of third-party services is subject to their respective terms and policies.

14. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Keyvalue Software Systems Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

15. Termination and Suspension

We may suspend or terminate your access to the Service for violation of these Terms, fraudulent use, or extended inactivity.

You may terminate your account at any time through the in-app delete account option or by following the process at getdailytadka.in/delete. Upon termination, your right to access the Service ceases immediately. Unused subscription time is not refunded unless required by applicable law.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute shall first be addressed informally by contacting us at dailytadka@keyvalue.systems. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kochi, Kerala, India. Subject to the arbitration clause, the courts of Kochi, Kerala shall have exclusive jurisdiction.

17. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified through the website, app, or other reasonable means. Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
